By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to Charge Inc.

Charge Inc. is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The Charge app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We, therefore, recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Charge app won’t work properly or at all.

When using Charge app you are responsible for:

  1. Everything you do through the app;
  2. Keeping your login information secure;
  3. Following these Terms and Conditions as well as applicable laws and regulations;
  4. Adhering to rules and regulations on patents, trademarks, copyrights, and intellectual property rights.

You cannot use Charge app for:

  1. Calling to violence, terrorist activities, or committing acts punishable by law;
  2. Committing fraud or conducting any illegal activity;
  3. Posting personal information without consent;
  4. Spreading malicious software, viruses, miners, or software with hidden functionality;
  5. Transferring adult, erotic, sexual, violent, offensive, trademarked, protected, or otherwise restricted content;
  6. Impersonating someone;
  7. Abuse, stalking, harassment, threats, deanonymization, intimidation of others;
  8. Stealing personal data including but not limited to usernames, contact information, and user photos.

We may terminate your account at any time without notice for violation of these Terms and Conditions, applicable laws, and regulations, based on a court order or an order issued by the authorized public agency or based on our judgement if your actions lead to or may potentially lead to loss of damage to reputation, loss of goodwill, damages, loss of data, inhibit the functionality of the app, disturb Charge app developers or users.

Unless we tell you otherwise, upon the termination of the Charge App’s functionality for any reason, (a) the rights and licences granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

CHARGE MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND WHETHER EXPRESS, IMPLIED (EITHER IN FACT OR BY OPERATION OF LAW), OR STATUTORILY. CHARGE EXPRESSLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY, ACCURACY, TITLE, AND NON-INFRINGEMENT. CHARGE DOES NOT WARRANT AGAINST INTERFERENCE WITH THE USE OF THE SERVICES OR SOFTWARE OR AGAINST INFRINGEMENT. CHARGE DOES NOT WARRANT THAT THE SERVICES OR SOFTWARE ARE ERROR-FREE OR THAT OPERATION OF THE DASHBOARD, THE API OR THE SERVICE WILL BE SECURE OR UNINTERRUPTED. CHARGE EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY ARISING OUT OF THE FLOW OF DATA AND DELAYS ON THE INTERNET OR IN CONNECTION WITH ANY USE OF ANY APPS OR SOFTWARE PROVIDED OR USED BY CHARGE. YOU USE CHARGE PRODUCTS AT YOUR OWN RISK AND THE SERVICES ARE PROVIDED TO IT ON AN “AS IS” AND “AS AVAILABLE” BASIS. CHARGE WILL NOT BE LIABLE FOR ANY DAMAGE, INJURY, LOSS OF DATA, LOSS OF CONTROL, LOSS OF GOODWILL OR ANY OTHER LOSSES, LIABILITIES, OR DAMAGES CONNECTED WITH THE USE OF CHARGE APP.

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
